摘 要:近年来,我国政府通过立法建制、健全组织领导体系、加强对话协商、强化劳动监察、突出权益保障等措施,从不同的向度对和谐劳动关系进行调控。但我国和谐劳动关系顶层设计有瑕疵,制度体系不完善;制度执行有偏差,政策目标没有完全实现;政策环境有待改善,支持系统不充分稳当。以法治思维和法治方式推进构建和谐劳动关系,应从规范顶层设计着手,建立健全更加科学完善的劳动关系法律和政策制度体系;坚持以结果为导向,进一步强化劳动关系政策制度执行;进一步推进就业优先战略,保障劳动者充分就业体面劳动;进一步转变政府经济管理职能,优化劳动关系治理的政策环境。In recent years, China' s government has regulated labor relations from different perspectives through legislation, improving organizational and leading system, strengthening dialogue and consultation, enhancing labor supervision, labor rights protection and other measures. However, the top -level design of harmonious labor relations in China is flawed with defective system, biased implementation, policy environment in need of improvement and inadequate supporting system. In order to building up harmonious labor relations by the way of ruling of law, we should improve the top - level design, establish a more scientific legal and policy system of labor relations, enhance the implementation of labor policies, strengthen the strategy of employment priority and realize decent work, transform government functions of economic management and improve the policy environment of labor relations governance.
