群体性聚众犯罪的生成原因与预防对策探析

摘　　要：当前,群体性聚众犯罪不断增多。该类犯罪的发生有其必然的个体原因和社会原因。在个体原因层面,参与者利益或诉求难以实现、社会不良心理影响、民众维权意识增强与法制意识淡薄等促使该类犯罪。在社会原因层面,主要表现为社会转型和深化改革新时期的社会大背景、相关法制规范不健全不完善、官员腐化堕落和作风不实、不实信息肆意传播等。因而,预防群体性聚众犯罪是一项系统工程,需要在加强社会心理疏导、及时化解社会矛盾,创新法制宣传方式、增强民众法制观念,健全法制规范、畅通诉求表达渠道,做好群众工作、保障群众利益,加强社会舆论引导等方面下功夫。At present , the commission of crimes involving assembled crowds has been on a steady rise .The hap-pening of this kind of crime is attributable to both individual and social reasons .At the individual level , partici-pants of the crimes involving assembled crowds are usually faced with compulsion and life problems due to their un -attainable interests and demands or due to the adverse psychological effects caused by the society .Meanwhile , a-wakening public awareness of safeguarding individual rights and interests versus poor public awareness of the law is also one of the contributing factors behind crimes committed by assembled crowds .At the social level , the huge context of accelerating social transformation and deepening reform in China , the imperfections in China ’ s current legal framework , the corrupt and depraved practices of a handful of Chinese government officials , the dissemination of rumors and false information , et cetera, have all fanned up the flames of crimes committed by assembled crowds . Therefore, in order to prevent such crimes from occurring , all-out and systematic efforts need to be done to strengthen social-psychological counseling, resolve social contradictions in a timely manner , innovate in new ways of legal and judicial publicity, enhance public awareness of the law , improve legal provisions and framework , smooth out the channels for expressing public opinions , score more achievements in the long course of mass work , protect the interests of the masses ,strengthen the channeling of public opinions , et cetera .
