摘　　要：共同体给人的感觉总是一种温暖共存的憧憬,无论共同体是以什么实体形式进行表现,无论他们使用了什么价值理论或者法律规则,都表达出了温馨圈子的共存理念。然而个体之间的利益矛盾激化掩藏在共同体的美好假象中,共同体体现了安全稳定感,但同时也一定程度地剥夺了个体自由和权力地位,虽然它们可以或好或坏地获得平衡,但不可能永远和谐一致。确定性和自由、共同体和个体之间的冲突,永远也不可能完全解决,本文试图以共同体存在的隐患为出发点,分析法律在其构建与发展过程中的调节作用,并对其中存在的机遇和危险作出评估。The community gives a warm feeling of coexistence, no matter what kind of physical form performance would commumty have, what value theory and legal rule they would use, a coexistence concept in the warm circle is expressed. However, the intensification of interest conflicts between individuals is hidden in a beautiful illusion, on the one hand, the community reflects a sense of security and stability, on the other hand, it deprives some rights of individual freedom and power status to some extent. They can be balanced in the circle, but they may not keep in harmony. The conflicts between certainty and freedom, as well as community and individuals, will never be fully resolved. This paper, starting from the risks in the community, attempts to analyze the functions of legal regulation and makes assessments on the opportunities and dangers.
