司法社会工作介入违法青少年教育监管研究——基于我国澳门特区的实践与经验

摘　　要：预防与控制青少年的违法行为是司法社会工作的关键领域。我国澳门特区建立了少年司法的混合模式,为社工专业的介入提供了空间。澳门特区政府颁行了《违法青少年教育监管制度》,立法授权社工专业人员在少年司法领域中承担重要的角色。在少年司法程序中,澳门司法社工有权出席调查证据的联合会议和法庭听证,提出质询,对判决发表意见,参加复和会议。澳门司法社工还享有制作社会报告和判前社会报告的职权,并担负执行多项教育监管措施的职责。虽然在跨界合作、自身角色和专业素质方面,澳门少年司法社会工作还存在一些困境,但其制度与实践仍然具有重要的借鉴意义。Juvenile delinquency prevention and control is the key field in justice social work.Macao established an integrative model of juvenile justice system, which leaves great room for socialworkers＇ intervention. According to this system of education and tutelage of juvenile delinquency, social workers are authorized to participate in juvenile justice and even play significant roles. In the juvenile justice procedure, Macao＇s social workers are entitled to witnessing the investigation joint mee-tings and hearing meetings, inquiring participators, advancing a proposal before judgment, and joiningin the restoration meetings. Those in Social Welfare Bureau and the Department of Return-to-Societyattached to Legal Affairs Bureau have the authorities to make social reports, including before-judgment social reports, and take on the duties to implement some measurements of education and tute-lage. Although there are problems in inter-discipline cooperation, its inner roles and professional com-petence for Macao justice social work, such a system and practices are of important enlightening to us.
