虚假诉讼刑法规制及其完善——以《刑法修正案(九)草案》为视角

摘　　要：针对日益严重的虚假诉讼,《刑法修正案(九)草案》(以下简称修正案草案)第三十三条对于虚假诉讼在刑事立法上予以规制。在《刑法修正案(九)》正式出台之前,欲于此探讨虚假诉讼行为上升为刑事犯罪之立法理由,对虚假诉讼犯罪之条文进行分析,并通过分析虚假诉讼犯罪立法设置在罪状、法定刑方面存在的诸问题,提出虚假诉讼犯罪的立法完善建言。Since the false lawsuit has become increasingly serious, the 33rd article of the Draft Criminal Law Amendment Bill （IX） regulates it in criminal legislation. Before the amendment bill is promulgated, this paper explores the legislative reasons for formulating it as an unlawful act, and analyzes its existing provisions. Moreover, it also proposes series of suggestions to improve the legislation in false lawsuit by analyzing the various problems in the facts about crime and punishment.
