试析企业刑事涉案风险的预防和控制

摘　　要：在风险社会背景下,社会风险具有风险广泛性、不确定性和相互关联性等特点。在这些风险的制约下,企业刑事涉案风险呈现出易发性、灾难性、责任多重性等特点。在这些风险的影响下,企业在设立、经营直至破产等环节中,都存在着可能使自身卷入刑事案件的危险。如果对这些威胁处置不当,可导致企业生产中止,直至破产倒闭。而依据事先防范、事中控制、事后补救的原则要求,依法采取相应的防控措施,企业则可以有效地防控这些风险,保障企业健康发展。In the risk society, widespread and uncertainty are the main characteristics of risk. The risk of enterprise involved in criminal cases also has the feature of susceptibility, catastrophic and the responsibility of multiplicity. Under the influence of these risks, there are all kinds of threats in the process of establishment, management and bankruptcy of the enterprise, which may make the enterprise involved in criminal cases. If these threats can＇t be dwelt with correctly, it will make these enterprises suspend production until be shut down. However, under the requirements of the principle that ＂prior prevention＂, ＂control in the process＂, ＂remedy＂, if the measures are taken to deal with the threats according to the law, these enterprises will go smoothly.
