摘　　要：在物业服务合同的履行过程中,抗辩权的不当行使可能会给公共环境和公共利益造成损害。从物业服务合同履行中抗辩权的表现类型入手,分析物业服务合同履行中滥用抗辩权的弊端以及我国法律规定的缺陷,提出规范物业服务合同履行中抗辩权行使的措施,旨在对解决实践中频繁发生的物业纠纷起到一定的借鉴作用。In the performance of the property service contract, improper exercise of right to defense might hurt the public environment, and harm public interests. This article starts with the type of the right to defense in the performance of the property service contract, detailed analysis is done on the abuse of the right to defense in the performance of the property service contract and the defects of the law in our country, and finally the standard measures of the exercise of the right to defense in performance of the property service contract are propsed to provide certain reference to the solution to the frequent property disputes in practice life.
