合同法视角下完善家庭医生签约式服务的思考

摘　　要：目前家庭医生签约式服务存在签约率未达到预期目标、契约服务内容履行不能、服务质量未达到预想效果等问题,其根源在于契约双方的信任危机、权责不明及制度保障的缺失与落实不到位。家庭医生签约式服务契约双方签署服务契约后理应具有法律效力。本文借鉴发达国家和国内开展家庭医生签约式服务的成功经验,对"契约"关系的性质进行法律梳理,在合同法的视角下进一步明晰签约服务人群主体范围及契约双方当事人的权利、义务与法律责任,以切实推动家庭医生签约式服务制度规范化、制度化、法制化发展,使居民得到便捷、高效、安全的医疗卫生服务。The problems facing family physician service include loW rate of contract signing, impossibility of performance of contract content and service quality not reaching expected effect. The root causes of the problems are the crisis of confidence betWeen tWo parties, ambiguity of poWer and duties, the lack of institutional guarantee and ineffective implementation. The contract signed by both parties should have legal effect. DraWing on successful experiences from developed countries and some areas in china,We made an analysis of the nature of the ＆quot; contract＆quot; relationship and further clarified the scope of subjects and the rights, obligations and legal responsibilities of both parties, in order to provide references for the standardization,institutionalization and legalization of the signing service of family physician and to provide residents With convenient,efficient and safe health services.
