刑事诉讼文明视角下刑事冤错案件的纠防

摘　　要：刑事冤错案件是刑事冤案和刑事错案的简称,突出强调的是我国刑事错案往往以刑事冤案的形式来表达。刑事诉讼文明是刑事诉讼程序实施过程中体现刑事诉讼进步和开化状态的标志,是刑事诉讼理念文明、制度文明、行为文明和载体文明的总和。在刑事冤错案件纠防的理论和实务中,很有必要导入刑事诉讼文明的相关理论和思维模式,牢固树立正当程序理念、切实贯彻人权司法保障制度和严格规范侦查讯问程序。The criminal misjudged and injustice cases are referred to the criminal injustice and misjudged cases,which are often expressed in the form of injustice cases. The criminal procedural civilization embodies a progressive state of being freed from ignorance and savageness in the process of the criminal lawsuit procedure implementation; it is the mark of the progressive and civilized state of criminal procedure and it is the sum of four civilizations： the civilization of criminal procedural idea,institutional culture civilization,behavior civilization and carriers of civilization. In the theoretical and practical research of criminal injustice and misjudged cases,it is necessary to import the relevant theory and thinking patterns of criminal procedural civilization,to firmly establish the idea of legitimate procedure,and effectively implement legal protection system of human rights and strictly regulate the judicial investigation and interrogation.
