摘 要:在"马士基公司、厦门外代与瀛海公司国际海上货运代理经营权损害赔偿纠纷案"中,各级法院对于国际班轮运输公司是否应负担强制缔约义务有所分歧。对此,根据适用强制缔约的"递进式适用标准",并在此基础上通过对我国法制环境的分析、参考滥用市场支配地位的认定因素、基于对货方利益的保护,得出否定国际班轮运输公司强制缔约义务的结论,并进一步分析了此结论对于契约法中准确定位强制缔约制度的理论意义,以及保障我国国际班轮运输市场竞争环境良性发展的实践意义。In the ease of damages dispute of international maritime freight forwarding franchise among Maersk, Xiamen Ocean Shipping Agency Company and Xiamen Yinghai Development Company, courts at all levels hold different views about whether international liner shipping company shall bear the obligation of mandatory contracting. For this, according to "progressive applicable standards" and analysis of China' s legal environment, referring to the identified factors about abuse of a dominant market position, and basing on the protection of the cargo owners' interests, we can draw a conclusion that the mandatory contracting obligation of international liner shipping companies shall be negated, and we further analyzed the theoretical significance of accurate locating of compulsory contracting system in the contract law, and the practical significance of protecting the healthy development of competitive environment in China' s international liner shipping market.
