论审判监督制度与司法公正的关系——以民事诉讼法的修订和完善为视角

摘　　要：民事审判监督制度是我国民事诉讼中的一项重要制度。此次民事诉讼法的修订对民事审判监督制度方面的规范尚不完善,有不少值得商榷的地方,需要在以后的立法和实践中逐步完善。我国的审判监督制度依附于民事诉讼法之中,成为民事诉讼法的附属品,在审判实践中带来了许多的问题。我国的理论界和实务界应该以此次民事诉讼法的实施为契机,重塑民事审判监督制度,力保司法公正,坚守好社会正义的最后防线。Our country＇ s judicial supervision system attached to the civil procedure law, it has become the accessories of the civil procedure law, which has brought many problems in the judicial practice. Chinese theory and practice circles should take the implementation of the new civil procedure law as an opportunity, reshape the supervision system of civil justice, ensure judicial justice, and adhere to the last social defense line of justice.
