论我国民事诉讼证据保全制度的缺陷及其完善

摘　　要：我国2013年修订的新民事诉讼法明确了规定了诉前证据保全制度,力图最大化地保障当事人的诉讼权利,然而采用鉴定方法保全证据的规则和民事诉讼法中鉴定意见的运用规则两者之间存在着矛盾,削弱了诉前证据保全制度的立法本意。有必要通过设立及时质证制度,补充规定证据保全情形中鉴定意见的特殊运用规则,加大对失信鉴定机构和鉴定人员的惩罚力度,消除现行民事诉讼中的内在矛盾,保证法律制度的衔接性,切实发挥证据保全制度的效用。The new revision civil procedure law of our country in 2013 has been clear about the system of evidence preservation before litigation, attempt to maximize the protection of the litigation rights of the parties,however, there is contradiction between the rule of evidence preservation by appraisal methods and the rule of using expert opinion in civil procedure law, thus weakened the legislation intention of evidence preservation system before litigation. It＇s necessary to set up the instant cross-examination system, add supplementary provisions concerning special using rule of expert opinion evidence in the situation of preservation, increase the penalties for faithless appraisal organization and appraisal personnel, to eliminate the contradiction of our civil procedure law, ensure the unification of the law, and develop the effectiveness of evidence preservation system.
