摘　　要：国家治理体系具有深刻的历史传承性,也具有鲜明的时代特殊性。传统文化中的法家、儒家、道家思想涉及政治、伦理、法律、哲学等方面,其思想、精神对我国法治建设产生了深刻的影响。社会主义法治建设要在传承中华传统文化的基础上,继承、发扬其积极因素,回避、抛弃其消极作用,以批判继承的眼光对待源远流长的传统文化。The national governance system has profound historical inheritance, also has a distinct special era. The Legalism, Confucianism, and Taoism in Chinese traditional culture involved politics, ethics, law, and philosophy, and theirs thought and spirit have had a deep influence on the construction of rule of law in China. The construction of socialist rule of law has to be based on the inheritance of traditional Chinese culture, inherits its positive factors and abandons its negative effect, treating the traditional culture from the perspective of critical inheritance.
