摘 要:雇佣裁判所作为英国裁判所体系的成员之一,2007年依据《裁判所、法院与执行法》从行政系统划归司法系统,苏格兰于2013年完成这一改革。通过对苏格兰爱丁堡雇佣裁判所的考察,可以发现,"司法化"的雇佣裁判所在更为规范、中立的同时,也保留了便民、经济的原初特性,这一特性因2013年收费制度的引入而有所削减,收费制度也影响了雇佣裁判所与其它劳动争议处理机制之间的关系,行政与司法在劳动争议处理中的功能呈现历史性回归。合理定位不同劳动争议处理机构的角色与功能,是英国雇佣裁判所制度之于我国的启示。Employment tribunal,being a member of the British Tribunal system,transformed from administrative system into judicial system according to "Tribunals,Courts and Enforcement Act"in 2007,in Scotland this reform finally accomplished in2013. Through examination of the reform of employment tribunal in Edinburgh,Scotland,we can found the new judicialized tribunal become more standardized and neutral as well as retaining its original characteristics of convenience,economy,though these characteristics got little damaged by the reform on litigation costs in 2013,this new charging system also affect the relationship between employment tribunal and other labor dispute settlement,the executive and judicial functions in the labor dispute process presents a historic return. Making all kinds of labor dispute settlements into more reasonable position is the enlightenment which we can get from the British Reform.
