摘  要:物业服务合同的性质在学界存在着不同的观点和看法,主流观点是将其定性为一种委托合同,认为其是业主将物业管理事项委托给物业服务企业管理而签订的合同;还有将其定性为服务合同、混合合同甚至是纯粹的无名合同等。虽然学界对物业服务合同的性质存在不同的看法,但将其归类为民事合同的一种确是上述所有观点的统一看法,因物业服务合同约定的管理、服务事项具有较强的专业性、公益性,且物业服务企业的经营活动具有特殊性,因此,应当将其定性为一种独立的民事合同。The nature of the realty property service contract in academic circles there are different views and opinions, the mainstream view is its qualitative is an agency appointment contract, believe that education is the owner will matters entrusted to realty service enterprise management and property management contracts signed. And its qualitative for the service contract, mixing and even pure nameless contract, etc. Although academic views on the nature of the realtyproperty service contract are different, but it is classified as a kind of civil contract is a unified view of all of the a- bove views, because of the realtyproperty service contract management, with strong professional, public welfare service items, and realty service enterprise management activity has particularity, therefore, they shall be as an independent civil contract.
