摘　　要：《刑事诉讼法》修改中,将"事实是证据"改为"材料是证据"是用西方国家的形式证据观取代了我国的实质证据观,是证据观的倒退。移植的证据排除规则对于排除物证、书证来说是反科学的。移植的"排除合理怀疑"的盖然性标准也不科学,因为盖然性根本不能作标准。移植的"无罪拟制"只是一个既不发生法律效力、更不能执行的虚假拟制。这次修改纠正了起诉不移送案卷的做法,但又允许侦查阶段委托辩护人。这是在侦查中虚构了控、辩关系。以上内容已使我国的证据制度具有了中西结合的倾向。如果按这一倾向继续走下去,中国的证据制度必将以"西化"而告终。我国的目标应当是:不要西化要创新。因为,创新才是硬道理。The criminal procedure law changes＂ the fact is evidence＂ instead of ＂the material evidence＂.
