摘 要:在农地转为非农用土地的现实过程中,由于"国家征收"与"集体转用"政策差异,造成了土地增值收益归属不同主体的较大差异。文章以土地的国家征收与农地集体转用产生的利益差别为视角,从土地农转非政策的演化,研究土地农转非政策的初衷,并非侵占农民土地增值收益;土地农转非政策作为一个变量,直接或间接影响农转非土地增值收益;土地非农化政策产生的偏差,致使农转非土地增值收益分配利益失衡:土地国家征收政策中"公共利益"需要与"经营性"需要并存,地方政府由"管理型"政府异化为"经营型"政府;农地转为集体建设用地"合法"与"非法"并存,农地增值收益分配混乱;土地补偿征用中"暴富群体"与"三无农民"并存,征地陷入"补偿困境"。Because of the policy disparity between State expropriation and collective diversion,there is a great gap in the allocation of land value increment in the process of transforming agricultural land to non-agricultural uses. From the perspective of the gap out of the two different ways of land use transfer,this paper analyzes the original intention of the policy from its evolution,and deems that it is not intended to encroach the land value increment of the peasants. The policy of transforming agricultural land to non-agricultural uses,directly or indirectly affects the land value increment of the related land. The disparity in the policies leads to the imbalance in the profit distribution of the land value increment. In the State land expropriation,the coexistence of public interest and business interest makes the local government transform from a management government to operating government; the legal and illegal handling coexist in transforming agricultural land to non-agricultural uses which leads to the chaos in the distribution of land value increments. The upstarts coexist with farmers without land,job or social security in the compensation for land expropriation,making land requisition trapped in a compensation dilemma.
