摘　　要：实行严格的土地用途管制,是多数国家的成熟做法。如果全国建立城乡统一的建设用地市场,则农村集体土地可直接用于矿山企业,但只有符合规划和用途的农村土地才能许可开发利用。应明晰市场的自由与限制,集体土地物权的市场交易是自由的,土地利用的行业准入则应受到严格限制。严格用途管制,主要目的是为了社会公众利益以弥补市场不足,基本依据是土地利用规划和年度计划,市场工具是增减挂钩以及"地票"形式等。Strict control of land use is a mature approach in most countries. China has established a market for construction land. Rural colective land is used directly by mining companies. Only areas designated construction land are permitted to be developed. It is necessary to clarify the limit and freedom of the market, as market transactions involving colective property attract no charge, and the development ability of such land is limited. Strict control of land use is necessary to make up for the lack of a land market and to protect the public interest. The fundamental basis of such control is land use planning and the formulation of annual plans, and a useful tool is change links or land ticket.
