摘  要:宏观调控权的合法性不能仅来自于法律授权,更应凭借实践效果强化权力的正当性。在法治规则上,应平衡中央与地方的不同诉求,重点完善约束中央调控权力的制度建设,并构建及完善调控退出制度。在法治手段及方法上,应合理安排调控措施的时间窗口,从公布到生效应留出合理时间并加强宣传解释;同时明确淡化直至摒弃行政强制手段,增加财政手段和货币手段的地方性和弹性。在法治机制上,应着重通过引入专业机构和公众参与强化并完善调控的绩效评估。The legality of the macro-regulative power cannot solely depend on the authorization form the legislatures, but should show its legality through the practical function. As to the rules, we should keep balance between the central government and local governments by coordinating their different interest demands, and especially improve the legal systems to limit the regulative power of the central government, and comprise the withdrawing system of the concrete regulative methods. As to the approaches and methods, we should arrange the timing window of implementing the regulative methods appropriately, set the reasonable timing table and strengthen the declaring and explanation; meanwhile, we should reduce even drop in the compulsive administrative methods, and promote the localization and flexibility of the government budget methods and financial methods. As to the mechanisms, we should promote the effect valuating of the regulation by introducing the professional institutions and public attendance.
