摘　　要：加罗法洛在《犯罪学》一书中首次提出自然犯罪。自然犯罪是独立于法律之外的犯罪概念,以对基本道德情感的侵害为实质,无道德异常便无自然犯罪。透过自然犯罪的界定评判应罚事实与真正罪犯,既深刻又片面。其在一定程度上无法满足现代犯罪与刑罚的社会需要,因此对自然犯罪理论在当下的承接与差别作出反思,进而正确理解和适用自然犯罪。Garofalo has proposed the concept of natural crime in Criminology for the first time. Natural crime is an independent criminal concept out of legal concepts. It treats the violation of the basic moral emotion as the essence. No moral abnormalities have not natural crime. Through the definition of natural crime to judge the punished facts and real criminals, is profound and one - sided. To some extent, it cannot meet the social needs of modem crime and punishment. Therefore, by reflections on the theory of natural crime once again, it can make the difference in the moment more clear and apply itself more reasonable.
