民用航空器适用善意取得制度的可行性辨析

摘　　要：在符合善意取得成立条件时,绝对价值和体积并未作为其适用的否定性条件,民用航空器价值高、体积大的特性因而并不成为阻碍其适用善意取得的实质性条件。在《物权法》体系中,民用航空器属于动产范畴,视其为不动产从而否定其适用善意取得制度的论述不成立。无论是将善意取得与登记对抗的关系进行何种建构,民用航空器登记对抗制度都未造成其适用善意取得制度的困局。在法律上和事实上,民用航空器均具有适用善意取得制度的可行性。When essentials of bona fide acquisition are satisfied, the absolute value and volume are not negative elements.Physical characteristics of civil aircraft, such as high value, or great bulk would not constitute virtual elements which impede the application of bona fide acquisition.Civil aircraft falls under the category of movable property in the system of property law, the opinion, that bona fide acquisition is non-applicable to civil air craft because it shall be deemed as real estate, is false.However, the rela-tionship between bona fide acquisition and registration antagonism is construed, the registration antago-nism of civil aircraft is not the obstacle of bona fide acquisition of it.In law and in fact, there is possibili-ty of application of bona fide acquisition to civil aircraft.
