摘　　要：基因权利具有基本人权的属性,应确认其基本法律地位,以作为解决基因歧视问题的法律依据。针对基因歧视在保险和就业领域中引起的伦理和法律问题,提出以下解决措施:保险领域中在遵循最大诚信原则的同时防止基因信息的不科学使用;就业领域中一般禁止原则与有限例外原则相结合。Because the gene right has the attribute of basic human right , as a legal basis for resolving the prob-lem of genetic discrimination , we should confirm its basic legal status .Genetic discrimination has caused the ethi-cal and legal issues in the field of insurance and employment , then put forward the following measures to solve these issues：In the field of insurance , the principle of utmost good faith should be followed to prevent the unscientific use of gene information;In the field of employment , the principle of general prohibition should be combined with the principle of limited exceptions .
