摘 要:欧盟反歧视指令中涉及就业歧视方面的内容及实施措施,推动了英国等成员国反就业歧视的法律规制,其中禁止就业歧视的重要事由、保护范围、方式、标准及抗辩,举证及救济等各个方面均有可借鉴之处。我国就业歧视的现象较为突出,亟待建立健全反就业歧视制度,从《就业促进法》的内容来看,有关就业歧视方面的规定依旧太过原则化,执法中缺乏可操作性。当前我国反就业歧视立法保护中还存在歧视事由与方式、保护范围与判断标准、抗辩事由、举证责任以及法律救济等方面的问题,因而存在制定《反就业歧视法》的必要性。The content and the implementation of employment discrimination relating to as- pects of anti discrimination of EU directive, promoted the legal regulation of Britain and other members of the anti employment discrimination, standard and defense important subject, scope of protection and mode, wherein the prohibition of employment discrimination, the burden of proof and relief of all aspects of reference ideas. Employment discrimination in China of the phenome- non is more prominent, urgently need to establish a sound system of anti employment discri mina- tion, from the "Employment Promotion Law" of the content, the relevant pro visions of the em- ployment discrimination is still too principle, law enforcement in the lack of operability. China~ current anti discrimination against employment protection legislation also discrimination causes and ways, the scope of protection and the judgment standard, defense, burden of proof, legal re- lief and other aspects of the problem, and develop "the necessity of anti employment discrimina- tion law".
