摘　　要：在新一轮考试招生制度改革背景下,围绕高校自主招生权行使的合法性、最优化目标,提出明晰公平秩序下特殊人才选拔的制度定位,科学合理划分政府与高校的法定权责范围,强化对招生自由裁量权合理运行的制约监督,依法加大对招生违规行为惩戒纠偏的力度等改革对策建议。Under the background of new round of Reforming of National Matriculation TEST, the essay aims at making proposals about clarifying system-positioning of Independent Recruitment as a way of special talent selection based on the fair order, scientifically and reasonably differentiating the legal authority and responsibility between administrative departments and public universities, properly strengthening the restriction and supervision of the Discretionary Power of the self-determination right of universities, severely punishing and rectifying the unlawful practice to realize the legality and effectiveness of self-determination right of recruiting students according to the law.
