摘  要:我国农村的农地承包经营权入股合作社及抵押,存在转让受限、入股程序缺位、合理价值评估、设定抵押或转让、破产清算时处置等问题。保障农户承包经营土地收益多元化,完善农地家庭承包经营权入股合作社,应坚持国家严格限定土地用途的原则,通过修改入股的限制性规定、建立价值评估机制、限制盲目扩大集中规模、完善社会保障制度等方式来实现。Buying shares in rural cooperatives with land contracting rights is significant. At present, there are many problems in buying shares in rural cooperatives with land contracting rights, such as limited transfer, absence of specific procedures, lack of reasonable value evaluation, and bankruptcy liquidation. To facilitate buying shares in rural cooperatives with land contracting rights, we should adhere to the principle of the strict limitation on land use, modify restrictions on buying shares with land contracting rights, set up the value evaluation standards, limit the blind expansion of buying shares with land contracting rights, and improve the social security system. .
