摘　　要：研究如何以农民权益保护为中心,构建家庭承包方式取得的土地承包经营权抵押制度,具有重要的理论意义与实践意义。在梳理国内外有关土地抵押制度的国内研究文献基础上,归纳总结对农民权益保护情况最新研究进展后提出建议:应以农民权益的实现和保护为中心,完善土地承包经营权抵押制度,重点在于科学界定土地承包经营权的权利结构,厘清抵押的主体资格、客体范围以及当事方权利义务关系,并据以适时修法。The research on how to focus on the protection of farmers＇rights and interests to build a mortgage system c of household contra oncerning the contractual right of land that is acquired by means ng, has an important theoreticaland practical significance. On basis of clarifying the domestic research literature about the land mortgage system at home and abroad, it summarizes the latest research progresses on the protection of farmers＇ rights and interests and then presents the advice： Focus on the realization ＆ protection of farmers＇ rights and interests to improve the mortgage system concerning the contractual right of land ; the key is to scientifically define the right structure of contractual right of land, and to make clear the right as principal, object scope, and the relationship of rights and obligations in due time is necessary between parties; and the amendment of laws in due time is necessary.
