刑事诉讼中涉案财产处理机制研究

摘　　要：在进行刑事司法活动时,对涉案财产的处理是否合理对公民的财产权利保护有着重要作用,然而我国刑法和刑事诉讼法有关涉案财产问题处理的一些规定还不完善。应根据我国目前涉案财物处理机制中存在的不足,探讨建设我国现行涉案财物返还机制,改进涉案财物处理机制,以促进我国刑事诉讼法律制度的进一步完善。In activities of criminal justice, properly handling the properties involved plays an important role in protecting the citizens＇ property rights. However, some provisions in the Criminal Law of PRC and the Criminal Procedure Law of PRC are not sufficient enough to handle the property involved in criminal proceedings. In view of the existing deficiencies in current mechanism, it＇s imperative to probe into the construction of the mechanism for the return of properties involved in China, complete the mechanism for handling properties involved in criminal proceedings, thereby further improving China＇s legal system of criminal proceedings.
