摘　　要：本文主要对于作者精神权利的设置、精神权利与人格权制度的关系等问题进行研究,同时探讨了作者精神权利制度对于艺术创作的影响,在此基础上,提出了作者精神权利制度的完善方法,主要有扩大精神权利的赋权主体,设置新的著作权制度防止精神权利对艺术投资和艺术创作的影响,在精神权利与人格权权利竞合的情况下赋予作者选择权,以及完善继承人不保护作者精神权利时的救济措施。This paper mainly studies problems such as the establishment of author's moral rights and the relationship between moral rights and personality rights system. It also discusses how artistic creation is impacted by the system of author's moral rights. Based on that, methods are proposed to improve the system of author's moral rights, mainly as follows: expanding the empowerment body of moral rights, setting up a new copyright system to prevent the impact of moral rights on the investment and creation in arts, giving the author an option in the case of cooperation-competition between moral rights and personality rights, and improving the remedies when the heir does not protect the author's moral rights.
