大学章程对高校办学自主权的界分与保障

摘　　要：章程是衔接大学内外的桥梁,它将国家法律法规转化为校内自治规范,是实现高校自主办学的基本依据。章程在落实高校办学自主权过程中具有独特作用,没有章程,就没有高校办学自主权。我国高校办学自主权落实难的原因主要是当前人们对高校办学自主权认识存在误区和高校自主办学能力建设不足。高校办学自主权是权利能力和行为能力的统一,具有相对性和层次性,是大学体现个性、彰显特色的原动力。通过大学章程厘清政府干预与高校办学自主权的边界,赋予大学章程法律效力,转变政府职能,确立高校独立法人地位,建立科学完善的高校内部治理结构,构建中国特色的现代大学制度,是高校办学自主权落实的必由之路。The charter is the bridge of cohesion inside and outside the university, the school autonomy state laws and regulations can be converted to the specification of the university autonomy, and the charter is a legal basis and basic way. The charter in the process of implementing the autonomy of higher education has unique function, no constitution, no autonomy of running universities. The root of the difficulty of the school-running autonomy in universities to carry out mainly on two mistaken understanding of autonomy of running universities. University autonomy is the unity of the rights and behavior ability, has relativity and level, are the lifeblood of the university reflect individual character, reveal features. The charter of the university to clarify the government intervention and university autonomy given boundary, the charter of the university legal effect, the transformation of government functions, the establishment of the independent legal status, improve the internal governance structure of universities, is the route one must take the university autonomy.
