摘　　要：在司法证明活动中,审判人员对于证据的审查认定的正确与否直接关系到案件事实是否清楚,并且这决定了裁判公正与否。因此在正确界定证据的基础上,我国应采取法定证明为主的模式,规范证据的采纳和采信,以进一步完善我国证据制度的建设。In the event of-judicial proof, whether the judges review the evidence correctly or not is directly re-lated to the facts that the ease is clear. And this determines the fairness of the judgment. Therefore, on the basis ofthe correct definition of evidence, the country should take the regulated proof, with standardized adoption and ad-missible evidence, in order to further improve the construction of evidence.
