摘 要:不当劳动行为是指,劳动关系中的雇主或者工会以不正当的手段,妨碍或者限制对方或者第三人行使其合法权利的行为。不当劳动行为法律制度的建立,主要是为了保护劳方的团结权,也可用于保障资方的利益。研究表明,在职业体育领域,资方和劳方都可以实施不当劳动行为。资方的不当劳动行为主要包括干涉雇员组织工会、报复行为和歧视行为;劳方的不当劳动行为主要包括不公平的代表行为、拒绝诚意的集体谈判等。不当劳动行为的救济途径有体育内部救济、行政救济和司法救济。中国职业体育劳资法律制度尚不健全,在我国建立不当劳动行为制度存在诸多障碍,如缺乏独立的职业体育联盟和运动员工会,但可以通过理顺职业体育劳资关系,推行集体谈判等措施为不当劳动行为制度的建立做好铺垫。Unfair labor practice refer to the employer or labor unions improper means, prevent or limit the other party or a third party to exercise their le-gitimate rights. The establishment of unfair labor practice legal system is to protect the labor's right of unity, and also can be used to protect the interests of investors. Research shows, employer and labor unions both can implement unfair labor practice in professional sports. The unfair labor practice behavior im-plemented by the employer mainly includes the interference the employees organization, revenge act and discrimination act etc. The unfair labor practice implemented by employee mainly includes unfair representatives, refuse collective bargaining, etc. The relief ways including sport association relief, adminis-trative relief and judicial relief. The professional sports labor legal system is not perfect in China, there are a lot of obstacles to establishment the unfair la-bor practice in China, for example, the lack of independent professional sports leagues and athletes union, but we can straighten out the labor relations in professional sports, and implementation of the collective negotiation measures to promote the establishment of the system of unfair labor practices in our country.
