摘 要:一般给付诉讼的适用范围须从客体范围及其行政诉讼类型的界分两个维度把握。一般给付诉讼的客体范围包括"直接"的财产性给付和行政行为之外的非财产性给付。考虑权利救济的完整性,应将颁布规范之诉、预防性不作为以及结果除去请求权纳入《行政诉讼法》第73条的客体范围。一般给付诉讼类型的界分应遵循"补充"和"备位"的功能原则,凡不属课予义务之诉(特殊给付诉讼)的客体范畴,均应归入一般给付诉讼。若以行政行为撤销与否为依据的,应提起撤销之诉合并给付请求。财产性给付限于可"直接"提起一般给付诉讼,如果依法必须先由行政机关核定其请求权者,应先提起课予义务之诉。When defining the application scope of the general payment litigation, the object scope and administrative litigation division should be taken into consideration. Since the object scope contains both the ‘direct' property payment and the non-property payment except administrative acts, for protecting all the rights, the standard promulgation litigation, the preventive omission and the claim of result remove should all be included into the object scope in the article 73 of the Administrative Procedure Law. The division of the general payment litigation should follow the functional principles of 'supplement' and 'preparation', i.e. all object scope except the obligation imposing litigation (the special payment litigation) should be included into the general payment litigation. If administrative acts being revoked or not is a precondition, then a revocation litigation should be suited along with the payment request. The property payment is limited to the 'direct' general payment litigation, whilst if the claim should be examined by the administrative body according to law the obligation imposing litigation should then be suited first.
