摘 要:效力是章程的生命,也是章程成为大学"办学宪章"的前提。章程的效力源自章程的自治性、法律性和规范性等基本属性。因此,当章程的生效机制仅依托大学单方制订文本和教育行政主管部门核准颁发来构建时,大学章程的制定已沦为形式,章程的效力必然缺失,"依法自主办学"依旧如空中楼阁。要让章程回归原本价值,重树严肃性和权威性,在认识上必须正本清源,认清章程的效力本源和现实基础,明晰大学的内外部治理主体和自主权范畴;在实践中必须厘清影响章程生效的各种关系,明确章程的制定主体,并根据各类高校的治理模式分级分类确定章程建设目标,设计合法的章程制定和核准程序,建立有效的监督和问责机制。Effectiveness is the key for the university articles of association, and it comes from its very nature which mainly includes such properties as autonomy, legality and standard. Effectiveness does not occur naturally with formulation of the text, nor with the approval government authorities. Otherwise the effectiveness of university articles of association would remain only on paper. To realize its effectiveness, there must be a full understanding of the theoretical and practical basis which generates the effectiveness, and there must be a clear classification of the internal subjects of university governance and the scope of autonomy accorded to each. In practice, there must be full recognition of all forces that may have influence on the articles of associate taking effect, choose and publicize organizations responsible for stipulating the articles of association, set goals of on difference levels and for different stages in accordance to the real situation of each university, design legal regulations and approval procedures, and establish an effective monitoring mechanism of accountability.
