摘　　要：在复杂的刑事司法活动中,刑事错案是无法摆脱也不能避免的客观事实。刑事错案成为一直困扰刑事司法理论与实践的难题。面对这一难题,首要任务是加强对刑事错案的理解和认识,厘清刑事错案的判定标准。在此起点上,刑事错案的发现、纠正、赔偿、追究等一系列救济措施才有展开的可能。Criminal misjudged cases is a phenomenon that we can＇t get rid of and avoid in complex criminal judicial practice.Faced with this problem, the first task for us is to strengthen the understanding of criminal misjudged cases and clarify the standardsof criminal misjudged cases. Then it is possible to expand a series of relief measures in discovery, correction, compensation andinvestigation of criminal misjudged cases.
