摘　　要：首先,介绍惩罚性赔偿在商品房买卖纠纷中的发展进路,并明确其制度价值;然后,对现行法律文件进行分析,以明晰其发展与不足;最后,从构成要件、赔偿金数额和归属以及适用范围等三方面探讨了惩罚性赔偿在商品房买卖纠纷中适用的相关制度。In this article, it firstly introduces the way of punitive damages in the disputes of commodity house trading to clarify its development and shortcomings： Then it discusses the ways to better the application of punitive damages in the disputes of commodity house trading, from three aspects： composition elements, sum and ownership of the compensation, the application range.
