摘　　要："依法治教"一词明显地反映出我国运用法律的方法调整或处理教育管理及教学中的各种关系的态度。结合我国依法治国的方略和教育改革的趋势,"依法治教"中应当确立人权理念作为指导思想。这既是我国践行人权理念,具体贯彻落实我国国家人权行动计划的需要,更是切实维护教育法律关系主体合法权益的需要。同时,通过依法治教中人权理念的树立,法学专业大学生就业能力的内涵将更加丰富。The word ＂ managing education according to law ＂ show a clear attitude to the use of the law in our country to adjust or deal with the relationship between education management and teaching. According to the strategy of ruling the country according to law and the trend of educational reform, the concept of human rights should be established as the guiding ideology in the rule of law. This is not only the implementation of the concept and action plan of human rights in China, but also the need to protect the legitimate rights and interests of the main body of education law. At the same time, according to the establishment of the concept in teaching, the content of the college students＂ emplovabilitv will be richer.
