摘 要:平等理论在宪法学教学中处于主线地位,其具体表现为:平等是以平等权为首的基本权利理论的明线,平等是以国家权力与公民权利为中心的宪法学分论的暗线,平等是以宪政与法治为核心的宪法学总论的隐线。宪法学教学中平等理论的实现路径具有二重性:既要做到在价值取向上坚持全课程内蕴平等理念,也要在内容安排上注意全课程观照平等问题的有机结合。在宪法学教学中坚持全课程内蕴平等理念的价值取向,要阐明宪法是人类追求平等的产物、宪法是平等法,平等是推动宪法发展的重要动力,平等是宪法学研究的主题等三个问题。宪法学教学在内容安排上注意全课程观照平等问题,在讲授宪法学分论中平等权问题、基本权利部分、国家机构部分及宪法学总论中都有一定的要求。Equality theory is in the mainline position of constitutional law teaching. Equality theory is an open wire of basic rights which is led by equal right theory, a dark line of sub - pandect of constitutional law which centers on the national power and civil rights and an invisible line of pandect of constitutional law which is focused on the constitutionalism with the rule of law. Those three aspects are the concrete manifestation of equality theory. Because of the duality of the implementation path of equality theory in constitutional law teaching, so in the whole curricula, it is necessary to adhere the implication equality in the value orientation, including the constitution is the production of human pursuit of equality; the constitution is an equal law and equality is an important impetus to promote the development of the constitution. And it is also important to pay attention to the organic combination of equality problem in the arrangement of content. For example, there is some demand to teach the equal rights, basic rights and national institutions of the constitution sub -pandect and the constitution pandect.
