摘 要:在现实生活中,当事人之间因合同之债、侵权之债、不当得利之债、无因管理之债均可依法设定担保。然而,不乏劳动合同中设定担保,该担保是否为担保法所调整则存在法律空白,造成裁判不一。其实,劳动合同担保大多是人事保证担保,不同于一般的保证担保,应当区分情形确认其效力。同时,借鉴大陆法系的立法规定,参考英美法系的经典判例,对担保的适用范围作扩张性解释,从司法解释层面和法律层面确立、完善劳动合同担保制度。In real life,act of guarantee can be established in accordance with the law where creditors seek to protect their rights in such economic activities as debit and credit,selling and purchasing,commodities transport and contracted processing. However,with regard to the establishment of acts of guarantee in labor contracts,whether the guarantee provisions in labor contract is adjustable by the existing guarantee law remains legally undecided,which results in different court rulings in reality. In fact,the act of guarantee in most labor contracts belongs to the realm of personnel guarantee,which is different from the guarantee in its general sense and therefore should be clearly defined in order to establish its efficacy. Meanwhile,with reference to the provisions in the legislation of the continental law system,and in light of the classic cases of Anglo-American law system,we attempt an expansionary explanation over the scope of the guarantee in the hope of establishing and improving the system of labor contract guarantee from aspects of judicial interpretation and legal provisions.
