摘　　要：生态补偿与生态文明有着内在的相关性与紧密联系。生态补偿是生态文明建设的重要内容和制度保障,而生态文明又为生态补偿制度建设指明了方向。在民族地区法制建设过程中,迫切需要生态补偿法律机制的构建,在生态文明视野下,重构民族地区生态补偿法律体系。具体要确认生态补偿在宪法中的地位;在《环境保护法》和环境与资源保护单行法中增设生态补偿内容;加快我国生态补偿专门立法;颁布区域性的生态补偿专项法规;促进民族地区地方生态补偿立法;完善生态补偿法律法规的执行、监督与惩处机制。With the increasing environmental problems, ecological compensatio n has become the primary means of ecological protection, Restoration and construction in minority areas. Ecological compensation and ecological civilization is inherently closely. Ecological compensation is an important part and system guarantee of the ecological civilization construction, and ecological civilization show clearly direction to the ecological compensation system construction. In the process of Legal Construction in minority areas,urgently need to build a ecological compensation legal mechanism. In the perspective of ecological civilization,reconstruct the ecological compensation legal system in minority areas. They are： Confirm the status of ecological compensation in the Constitution; Add the ecological compensation Content in the ＂Environmental Protection Law＂ and environmental and resource protection single law; speed up ecological compensation Special legislation;Promulgate regional ecological compensation special regulations; Promote ecological compensation legislation in minority areas;Improve the implementation,supervision and punishment mechanism of the ecological compensation laws and regulations.
