摘　　要：制度的生命力在执行。新刑事诉讼法颁布以来,公安司法机关通过多种形式,开展新刑诉法的学习和岗位实践练兵,使广大干警在短时间内基本熟练掌握了修改后刑诉法的新理念、新规定和新要求,尊重和保障人权的意识有了比较明显的提高。贯彻落实新刑事诉讼法过程中,公安司法机关在刑事和解程序的执行、强制医疗程序的使用、未成年人刑事案件特殊程序的执行、特殊犯罪嫌疑人的翻译聘请、量刑幅度的细化和监督、监所管理和社会服刑等方面有一些好的做法,积累了可贵的经验,但也存在一些不容忽视的问题。Vitality of the system lies in the implementation. Since the promulgation of the new Code of Crimi- nal Procedure, public security and judicial organs carry out the new criminal procedure law study and practi- cal job training through a variety of forms, to enable the majority of police officers grasp the new ideas, new regulations and new requirements of the revised criminal procedure law in a short period of time, so the aware- ness of respecting and protecting human rights has obviously improved. In the process of implementing the new Criminal Procedure Law, public security and judicial organs accumulated valuable experience in the imple- mentation of the criminal settlement procedure, mandatory use of medical procedures, implementation of spe- cial procedures of juvenile criminal cases, hiring translator to the special criminal suspects, refinement and supervision of sentencing range, prison administration and other aspects of social sentence. But there are some issues that can not be ignored.
