摘　　要：每一起冤假错案中都存在认证错误的影子。证据制度是认证活动最直接的制度背景和法律依据,证明对象、证明责任、证明方法、证据规则、证明标准等每一项证据制度都对认证活动产生重要影响,本文从各项证据制度与刑事认证的关系入手,考察它们对刑事认证的影响,以期为从证据制度入手提高我国刑事认证的质量奠定基础,以尽可能地避免认证错误,防止冤假错案的再度发生。Each wrongful case is a reflection of mistaken identification. Evidence system is the most direct system background and legal ground for identification, and identified subjects, i- dentification responsibilities, proof methods, regulations and standards are all related to the process of identification. In terms of the relationships between evidence system and criminal case identification, this paper probes into their effects on identification of crimi- nal cases. It is hoped that the research can serve as a reference of criminal case identification in China and minimize wrongful cases.
