摘　　要：近年来,以法律解释、法律论证、法律方法等为先导的司法方法探索方兴未艾。事实上,审判行为涉及的方式、方法与技术本身即是审判方法应关注的重点,科学审判方法的标准和终极意义也应是于严谨复杂的诉讼环节和程序要求中总结出简练易行的步骤,于法律条文和诉讼关系的纷繁交错中找出其公正适用的方法,于众说纷纭的案件事实中建立＂两造对立＂时的秩序与理性。《要件审判九步法》所总结的源自实践的审判方法,在某种意义上开辟了诉讼流程具体环节中审判方法研究的先河。本文将从司法审判有所依据的角度,对《要件审判九步法》一书进行一定程度的分析。In recent years,the judicial research with the methods of judicial interpretation,legal argument,and legislative method is carried out smoothly.In fact,the manners,methods,and techniques itself related to trial behavior are the main point which should be paid attention to by the trial methods,the standards and ultimate meaning of scientific trial method is to summarize the simple and practical step in the complicated and rigorous lawsuit links,and find a just and useful method in the strict links between the law articles and lawsuit relations,create the order and reason by founding the＂Both sides opposite＂from the various cases with different opinions.The trial method which was summarized from practice in the book The Elements Trial Nine-step Methodology is somehow the pioneer of the research method in the specific chain in the suit circuit.From the point of view of the legislative trial,a certain analysis is somehow analyzed to the book The Elements Trial Nine-step Methodology is carried out in this book.
