摘　　要：刑法不得已原则执基民众立场,载荷常识、常理、常情,依托人权保障,从刑法当为的内容追根溯源网络犯罪的刑罚边界,洞彻网络犯罪乃主观罪过支配的内在乾坤,揭示网络犯罪与传统犯罪同宗同源的实质意蕴,统一网络犯罪在秩序与人权、主观与客观、虚拟与现实、实害与风险之间的共识。刑法不得已原则以公众意愿考量他法是否能够有效调整以及不予刑法调整,相应的法律制度是否会崩溃,探寻区分赋值、刑事和解在网络犯罪之罪与非罪和缓连接中的不得已运用。在此罪与彼罪、重罪与轻罪的科予上,不得已原则又以公众情感直观测量刑量,并在相应的罪名之间以刑制罪,确保网络犯罪刑罚边界之适正性。In the perspective of criminal law principle to the principle of people＇s position as the position,with common sense,common sense,natural for content,emphasis on citizens＇ human rights safeguard.So the criminal law principle of necessity from the criminal law should be some content trace on the border of network crime.The criminal law principle of necessity to reveal the subjective fault is the key to network crime into whether,the criminal law principle of necessity to reveal the network crime and traditional crime is the same.The criminal law principle of necessity of unified network crime of real consensus in order and human rights,subjective and objective,virtual and reality,harm and risk,the criminal law principle of necessity to the public will consider other laws can effectively adjust,and there is no criminal law adjustment,the corresponding legal system will be paralyzed,that seek assignment respectively,criminal reconciliation in the network crime and crime is not a crime gentle connection to use.In the crime and he sin,and families to felony and misdemeanor,the criminal law principle of necessity use emotional direct measurement of punishment to the public,and to make in the corresponding charges between punishment against conviction,to ensure the legitimacy of cyber crime boundary.
