摘 要:中小学校承担的义务教育是国家的公共事业,中小学教师的教育权利和教育义务也是法定授权产生的,其实现过程由教育行政部门监督管理。教师作为公共部门的工作人员,应当以公共组织的公共精神为职业准则,不以市场中的逐利目标作为自己的职业理想,否则就会产生角色冲突,进而存在伤害公共利益的问题。中小学教师是国家公共事业的承担者,其行为具有公共伦理的特性,教师职业内蕴着教育权利和教育义务的公共性。有偿家教违背了基本的职业忠诚义务和回避责任,存在着利益冲突和利益输送的隐患。从教师职业道德的角度,对在职中小学教师有偿补课加强管理和规范是正当和合理的。Compulsory education, undertaken by primary and secondary schools, is a national public utility, and teachers' rights and obligations, engaged in primary and secondary schools, are also authorized by relevant laws, its implementation is administrated and supervised by the education administration departments. As public sector work- ers, teachers should follow the professional standards, i.e. the public spirits of public organizations, shouldn't harm the public interests in an effort to pursue profit and lead to role conflict. Primary and middle schools teachers are responsible for the national public utility, whose behaviors are of characteristics of public ethics and whose fession includes the publicity of educational rights and obligations. Paid tutoring violates the basic professional alty and dodges their responsibility, so there might be some hidden dangers of interest conflict and transport. legitimate and reasonable to strengthen and regulate the management of paid tutoring for the in-service primary middle schools teachers from the perspective of teachers' professional ethics.
