For Whom We Sweep the Snow?——On the Four Rules of Social Governance

摘　　要：文章从谚语"各人自扫门前雪,休管他人瓦上霜"提出的"雪为谁扫"、"雪由谁扫"的问题出发,论述了社会治理的四项基础规则,即个体权利和责任规则、交换与授权规则、保护弱者的规则、仁爱与善行的规则,并阐述了四项规则层层递进的逻辑结构关系。认为以道德方式为主的治理不是一种系统、可靠、公正、可持续的治理,依规则,依法治,才是构建公平正义社会秩序的治理大道。Starting from the two questions of＂for whom we sweep the snow＂and＂who should sweep the snow＂derived from the ancient proverb＂Let each one sweep the snow from his own doorstep and heed not the frost on his neighbor＇s roof,＂this article discusses the four basic rules of social governance,namely the rule of individual rights and responsibility,the rule of interchange and authorization,the rule of protection of the unprivileged,and the rule of kindheartedness and philanthropic acts.Meanwhile,this article also analyzes the progressive logic sequence of the four rules.It is concluded that governance mainly based on rules of virtue is not a systemic,reliable,fair and sustainable way of social governance,and that the construction and realization of the social order with fairness and justice rely on governance based on nomocracy.
