摘　　要：新《中华人民共和国刑事诉讼法》第188条首次涉及了近亲属免证特权,此次规定完善了证人作证制度,引发热议。文章试从探析近亲属免证特权制度在我国的历史发展结合域外考察来分析第188条的进步意义与存在的缺陷,同时为了完善我国刑事诉讼程序中的近亲属免证特权制度提出一些建议。The new ＂People＇s Republic of China Criminal Procedure Law＂ Article 188 first relates to the close relatives Testifying privilege, the provisions to improve the Witness System, sparked heated debate. The article tries from close relatives of the privilege system Testifying in the historical development of China＇s combination of progressive extraterritorial study to analyze the defects and Article 188, and in order to improve our criminal proceedings close relatives Testifying privilege system make some suggestions.
