农民工工伤保险保障机制发展对策——基于与医疗保险的关系

摘　　要：工伤保险和医疗保险是与农民工联系最为紧密和最为迫切的社会保险项目。基于农民工群体本身的特点以及来自用人单位和制度设计本身的缺陷,导致农民工参加工伤保险和医疗保险制度面临参保水平低、待遇不合理等一系列问题,本文据此提出完善农民工工伤保险保障机制的建议。同时,考虑到工伤和医疗在恢复农民工身体机能和健康方面的相似性,在完善工伤保险和医疗保险制度本身的同时必须要明确各自的责任范围,划定的标准则是依据近因原则。The industrial injury insurance and basic medical insurance system are the most pressing social insurance programs associated with migrant workers. The characteristics of the migrant workers themselves, along with employers＇ lack of responsibility and the defects of system design, makes migrant workers be faced with a series of problems such as low level of participating and unreasonable treatment, when attending industrial injury insurance and basic medical insurance system. Proposals of improving the system of migrant workers＇ industrial injury insurance safeguard mechanism are put forward based on the factors above. Considering there exists a certain degree of similarity on recovering migrants＇ body functions and health between the two social insurance programs, it＇ s necessary to clear the scope of their responsibility, as well as perfecting the systems themselves. The standard used to divide responsibility is based on the principle of proximate cause.
