美国众筹业发展及监管启示

摘　　要：近年来,我国众筹融资发展迅速,但对其监管起步较晚,法律制度相对滞后,部分众筹融资平台主体资格不合规、违规运营,存在风险隐患。作为全球最大的众筹市场,美国在市场培育、监管探索方面的经验值得我国借鉴。本文分析美国众筹业最新发展状况,剖析美国众筹监管探索解决的主要问题和监管法规的演变过程。在此基础上,本文结合我国众筹业发展实际,提出完善众筹业监管的建议。Recent years has witnessed rapid growth in China＇ s crowdfunding market, while market regulation has a long way to go and potential risks remain. With the largest crowdfunding market, the United States set an example in market cultivation and regulation. This paper presents the latest development in U.S. crowdfunding market, analyzes the key issues which regulation rules address, demonstrates the evolution process of crowdfunding regulatory rules. Combining the situation of crowdfunding in China, this paper suggests the ways to be taken to promote the crowdfunding development and regulation.
