摘　　要：刑事司法搜查制度是刑事诉讼活动中一项重要的侦查行为,由于该行为特殊的强制性,其在实施的过程中往往涉及到公民的财产权、隐私权、人身自由权等多方面内容。通过与域外的搜查制度相比较可以看出,现阶段我国的刑事司法搜查制度缺少细节性的规定。因此,建议重新确定搜查制度的审查主体,细化搜查制度的内容,并结合再修改后的《刑事诉讼法》对搜查制度进行进一步的修正与完善。In the process of criminal legal actions, the criminal judicial search system is an important investigative act which is often related to citizens＇ property rights, privacy, personal liberty etc. for its special mandatory nature. Compared with foreign regulations, our present criminal judicial search system is lack of details. Therefore, it is recommended to re-determine the examining body of the search system, refine the contents and make the search system further amended and perfected combining with the revised ＂Criminal Procedure Law＂.
