刑事诉讼维稳模式的困境与出路

摘　　要：在我国当前的刑事司法实践中,法定的刑事诉讼程序、规则、制度在一定程度上被规避、架空或搁置,出现了实践对制度背离的情形。刑事诉讼维稳模式的产生就是实践修正、脱离或者规避了法律制度设计的程序制约的结果。刑事诉讼维稳模式以维稳为行动导向,以命案必破、留有余地的判决、政法委协调为标志性话语,其在价值观念、思维方式及行动逻辑上存在的困境成为一些案件办案质量不高甚至引发错案的最为重要的结构性原因。通过运用法治思维、理性思维、精确思维来规范刑事诉讼实践,树立法治秩序和权利本位的价值观念,实现庭审中心主义等,能够克服维稳模式的困境,让刑事诉讼从异化回归常态,最大限度地实现司法公正,防范错案的发生。In the current criminal judicial practice of China,to a certain extent,the legal criminal proceedings rules and institutions are avoided,shelved or abstained,under such a circumstance,the criminal procedure practice is deviating from the system. The stability maintenance mode of criminal proceedings is resulted from the fact that the criminal procedure practice rectifies,avoids or evades the design constraints of the legal system. The stability maintenance mode of criminal proceedings is stability- oriented and marked with the discourse that the murder must be solved,that the room must be left in judgment and that politics and law committee makes coordination. The dilemma,which exist in values,ways of thinking and action logic,becomes causes of low quality of the case investigation results,even the most important structural causes of misjudged cases. By using the rule of law thinking,rational thinking and precise thinking to regulate the criminal prosecution practices,setting up both the rule of law order and the right- based values,the plight of the stability maintenance mode can be overcome,making the criminal proceedings return to normal from alienation and maximizing the realization of justice and preventing the occurrence of misjudged cases.
